This Privacy Policy describes the privacy practices of Duchesnay Inc. (a subsidiary of Duchesnay Pharmaceutical Group). This Policy describes the types of personal information and other information we collect from and about you online and offline when you interact with us or use our websites, apps, and other services (collectively, the “Services”), and how we use, store, and share the information collected.

We take privacy matters seriously. We are committed to respecting your concerns about privacy and respect your right to receive only communications that you wish to receive.

What is personal information?

"Personal information" means information that allows to identify an individual, directly or indirectly. This information may include your name, mailing address, e-mail address, and telephone number.

Personal information does not include information that has been anonymized or aggregated in such a way that there is no serious possibility it can be used to identify an individual, whether on its own or in combination with other information.

When does this Privacy Policy not apply?

Duchesnay is only responsible for the privacy statement and content of this its websites. We are not responsible for the privacy practices or the use of cookies on websites that you have accessed from our websites and for any independent website that you may access through our websites, and we encourage you to review all third-party privacy policies prior to using third party websites or products or services.

Where do we store personal information?

This is a Canadian website and is subject to laws of Canada. Duchesnay will disclose personally identifiable information without your permission when required by law, or in good faith belief that such action is necessary to investigate or protect against harmful activities to its websites, or property, or to others.

Your personal information may be stored in Quebec (Canada). Where appropriate, your personal information may be processed in any country where we have facilities or in which we engage third party service providers. As a result, your personal information may be transferred to countries outside your country of residence, which may have different data protection rules than in your country. While such information is outside of your country, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country.

However, our practices regarding your personal information are at all times governed by this policy and by applicable Canadian and Quebec privacy laws. In the case of any cross-border data transfers (the transfer of your personal information to other countries), Duchesnay will put in place appropriate safeguards to provide an adequate level of protection.

How do we collect your personal information?

If we need to collect personally identifiable information such as the name, sex, email, phone number, country, province, postal-code, or any medical specialty from you to provide you, notably through the Medical Information Form, with a particular service, we will ask you to voluntarily supply us with the information we need, in order to obtain your consent, or as permitted or required by law.

How we obtain your consent (i.e., the form we use; express or implied) will be subject to applicable laws and depend on the circumstances, as well as the sensitivity of the information collected. If you choose to provide personal information to us, we assume that you consent to the collection, use and disclosure of your personal information as outlined in this Privacy Policy.

Typically, we will seek your consent at the time your personal information is collected. If we want to use your personal information for a purpose not previously identified to you at the time of collection, we will seek your consent prior to our use of such information for this new purpose.

If you provide personal information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect, use and disclose his or her information as described in this Privacy Policy.

Note that we also collect information voluntarily provided by individuals when they interact with us including in person, by phone.

Why do we use your personal information?

We use personal information in a variety of ways to conduct our business and pursue our business interest, in particular to:

  1. (i)   to provide you with the Services and to support your use of the Services;
  2. (ii)   to contact you relating to the Services and to notify about a product recall, as may be required by the regulatory authority;
  3. (iii )  to monitor and improve the Services, and to develop new products and services;

  6. (vi)   to provide you with information that we think may interest you, including in regard to the Services;

(vii)   to investigate legal claims or comply with our legal obligations, notably the legal requirements to implement pharmacovigilance procedures to monitor adverse effects of marketed products, and to process product complaints. This also includes activities required to comply with regulatory requirements such as submitting reports to Health Canada/FDA and/or other relevant regulators.
  8. (viii)   to assess employment applications (when you apply notably through the career webpage and with the CV upload feature);

We may use your personal information for other purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable law.

Our websites do not collect personally identifiable information about you unless you voluntarily provide it to us.

Information collected automatically through our websites

When you visit our websites or use our Services, we may collect certain technical information automatically, such as your IP address, device information, information about the network you use to access the Services, browser type and version, your activities while using the Services, websites or services previously visited, and content you see or click on. We use this information to understand and analyze trends, administer the Services, learn about user behavior, and gather demographic information about our users as a whole.

Disclosure of information to third parties

We do not permit the sale of personally identifiable information and will not use the information we receive for commercial purposes.

We also rely on third party service providers to perform a variety of services on our behalf such as:

  • Hosting of our websites;
  • Tracking users on line;
  • Emailing and subscribing to the newsletter

If we provide your information to third party service providers, we take reasonable measures to ensure that the rules set forth in this Privacy Policy are complied with and these third parties provide sufficient guarantees to implement appropriate security measures. We also require that they only use your personal information for the limited purposes for which it is provided. When our service providers no longer need your personal information for those limited purposes, we require that they dispose of the personal information. How long do we keep personal information?

In some cases, we anonymize personal information, for serious and legitimate purposes, so that there is no serious possibility of linking the anonymized data back to an identifiable individual, directly or indirectly.

How do we protect your personal information?

We have implemented physical, organizational, contractual and technological security measures with a view to protecting your personal information and other information from loss or theft, unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that the only personnel who are granted access to your personal information are those with a business ‘need-to-know’ or whose duties reasonably require such information.

What are your privacy rights in Canada?

Under certain circumstances, you may make a written request to review any personal information about you that we have collected, used or disclosed, and we will provide you with any such personal information to the extent required by law.

You may also challenge the accuracy or completeness of your personal information in our records (access, deletion, and rectification). If you successfully demonstrate that your personal information in our records is inaccurate or incomplete, we will amend the personal information as required.

In addition, in certain circumstances, you may have the following rights:

  • you may withdraw your consent to the disclosure or use of the personal information collected, but such right may be limited. Before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain Services;
  • If you no longer wish to receive marketing-related emails from us, you can stop these sendings by clicking on the unsubscribe link available at the bottom of each of our emails.
  • You may have the right to request that personal information held about you no longer be disseminated.
  • You may have the right to request information about the use of any automated-decision system and the impact it may have on you.

Will we update this Privacy Policy?

Duchesnay takes your rights regarding privacy matters to heart. In the future, we may need to change this privacy statement. Any changes will be effective immediately upon posting of the revised Privacy Policy, and your continued use of our websites or our interactive features will be subject to the then-current Privacy Policy.

Do we collect information from minors?

Our products, our websites, and our other Services are intended for use by individuals who are legally considered to be adults in their jurisdiction of residence. We do not knowingly collect any personal information directly from individuals who have not reached the age of majority (minors).
